Terms of Service

ExcellaTek is a digital agency. We provide web development, custom software and SaaS development, cloud development and DevOps, mobile app development, UX/UI and product design, e-commerce development, SEO, digital marketing and paid media, website accessibility work, and ongoing maintenance and support.

This website describes those services and lets you get in touch about them. Nothing on this site is an offer, a quote, or a guarantee of any particular result. The specific scope, fees, timeline, and terms of any engagement are set out in a separate written agreement between you and ExcellaTek. If anything in that agreement conflicts with these Terms, that agreement controls.

You agree to use this site lawfully, and not to interfere with it, probe it for vulnerabilities, or use it to transmit spam or malicious code.

ExcellaTek operates a text messaging program for prospective and existing clients. These terms apply to it.

How you opt in

There are two ways to join, and you are only enrolled through the one you actually used. We never add a number to the program on our own initiative.

During a call with an ExcellaTek representative, you may be asked whether you would like to receive text messages from us. If you agree, we send a single confirmation request, and you must reply YES to confirm your consent. No messages are sent before that YES beyond that one confirmation request, and replying YES is what starts the program.

You may also enroll yourself at excellatek.com/sms-consent by entering your name and mobile number and ticking the consent checkbox. The checkbox is never pre-ticked, and submitting the form without it does not enroll you. Because you have already given express written consent by ticking that box and submitting it, the confirmation message is sent immediately on submission rather than in reply to a YES.

Whichever path you use, you receive a single message confirming that you are enrolled, and consent to receive text messages is never a condition of purchasing any product or service.

Cost

Data rates may apply. Message and data rates are charged by your mobile carrier and are your responsibility, not ExcellaTek’s.

Cancelling

Reply STOP at any time to cancel. You will receive one final message confirming that you have been unsubscribed, and no further messages will be sent after that confirmation.

Carrier liability

Carriers are not liable for delayed or undelivered messages.

Mobile information and consent collected through this program are not shared with third parties or affiliates for marketing purposes. See our Privacy Policy for details.

Contacting us, requesting information, or opting in to our messaging program creates no obligation on either side. You are not obligated to buy anything, and we are not obligated to take on any project.

No contract for services exists between you and ExcellaTek until both parties sign a written agreement. Information on this site is provided for general purposes only and does not constitute professional, legal, or financial advice. To the fullest extent permitted by law, the site and its content are provided “as is,” without warranties of any kind, and ExcellaTek is not liable for indirect or consequential damages arising from your use of the site.

All content on this website, including text, graphics, layout, design, code, and the ExcellaTek name and logo, is owned by ExcellaTek or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may view and print pages from this site for your own reference. You may not copy, republish, sell, or create derivative works from our content, or use our name or logo, without our prior written permission.

Ownership of work product created during a client engagement is governed by the written agreement for that engagement, not by these Terms.

We may update these Terms from time to time to reflect changes to our services or to legal requirements. When we do, we will revise the “Last updated” date at the top of this page.

Material changes to the SMS program terms will be communicated to enrolled participants. Continuing to use the site or the messaging program after an update means you accept the revised Terms. If you do not agree with a change, stop using the site and reply STOP to leave the messaging program.
